1. Acceptance of Terms

By accessing and using SelectiveGuru ("the Service"), you accept and agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our Service.

These Terms constitute a legally binding agreement between you and SelectiveGuru. If you are using the Service on behalf of a minor, you represent that you are the parent or legal guardian and have the authority to agree to these Terms on their behalf.

2. Description of Service

SelectiveGuru is an online educational platform designed to help students prepare for the NSW Selective High School entrance examination. The Service includes:

  • Unlimited practice questions across Reading, Mathematics, Thinking Skills, and Writing
  • AI-powered tutoring and personalised explanations
  • Adaptive difficulty adjustment based on performance
  • Progress tracking and analytics
  • Parent dashboard for monitoring student progress
  • AI-powered writing assessment and feedback

3. Account Registration

3.1 Account Creation

  • You must provide accurate, current, and complete information during registration
  • You are responsible for maintaining the confidentiality of your account credentials
  • You must be at least 13 years old to create an account, or have parental consent
  • One account per student is permitted

3.2 Account Security

You are responsible for all activities that occur under your account. Notify us immediately of any unauthorized use or security breach.

4. Subscription and Payment

4.1 Free Trial

  • New users receive a 14-day free trial of Premium features
  • No credit card required for the trial period
  • Trial converts to Free plan automatically if not upgraded

4.2 Premium Subscription Plans

We offer two pricing options:

  • One-Time Payment: $150 AUD (access through May 2026 test day)
  • Monthly Subscription: $49.99 AUD per month (recurring, cancel anytime)
  • Payment is charged at the beginning of each billing cycle for monthly subscriptions
  • All fees are in Australian Dollars (AUD) and include GST where applicable
  • Monthly subscriptions auto-renew unless cancelled before the renewal date
  • One-time payment provides access through the NSW Selective Schools test in May 2026

4.3 Refund Policy

Under Australian Consumer Law, you are entitled to a refund if:

  • The Service is not as described or fit for purpose
  • There is a major technical failure preventing use of the Service

Refunds for subscription fees may be provided at our discretion. To request a refund, contact support@selectiveguru.com.au within 14 days of purchase.

5. Cancellation

  • You may cancel your Premium subscription at any time through your account settings
  • Cancellation takes effect at the end of the current billing period
  • You retain access to Premium features until the end of the paid period
  • After cancellation, your account reverts to the Free plan

6. Acceptable Use

You agree NOT to:

  • Share your account credentials with others
  • Use the Service for any illegal or unauthorized purpose
  • Attempt to hack, reverse engineer, or compromise the Service
  • Copy, reproduce, or distribute our content without permission
  • Use automated systems (bots, scrapers) to access the Service
  • Upload malicious code, viruses, or harmful content
  • Impersonate others or provide false information
  • Use the Service to cheat on actual examinations

7. Intellectual Property

7.1 Our Content

All content on SelectiveGuru, including questions, explanations, designs, text, graphics, and software, is owned by or licensed to SelectiveGuru and protected by Australian and international copyright laws.

7.2 Your Content

You retain ownership of content you submit (e.g., writing samples). By submitting content, you grant us a license to use it for providing and improving the Service, including AI analysis and feedback.

8. Educational Disclaimer

Important: SelectiveGuru is a practice and preparation tool. We do not guarantee:

  • Success in the NSW Selective School entrance examination
  • Specific score improvements or outcomes
  • Acceptance into any selective school

Results depend on many factors including student effort, existing knowledge, and test conditions. Our platform is designed to supplement, not replace, comprehensive study and preparation.

9. Limitation of Liability

To the maximum extent permitted by Australian law:

  • We provide the Service "as is" without warranties of any kind
  • We are not liable for any indirect, incidental, or consequential damages
  • Our total liability is limited to the amount you paid for the Service in the past 12 months
  • Nothing in these Terms excludes or limits our liability for fraud, gross negligence, or death/personal injury

This limitation applies to the fullest extent permitted under Australian Consumer Law and does not affect your statutory rights.

10. Data and Privacy

Your use of the Service is also governed by our Privacy Policy. We collect, use, and protect your data as described in that policy.

11. Termination

We reserve the right to suspend or terminate your account if you:

  • Violate these Terms of Service
  • Engage in fraudulent activity
  • Abuse or misuse the Service
  • Fail to pay subscription fees

Upon termination, your right to access the Service ceases immediately. We may delete your account data, though some information may be retained as required by law or our Privacy Policy.

12. Changes to Service and Terms

We reserve the right to:

  • Modify, suspend, or discontinue the Service at any time
  • Change pricing with 30 days' notice to existing subscribers
  • Update these Terms of Service from time to time

Material changes to these Terms will be notified via email or platform notification. Continued use after changes constitutes acceptance of the modified Terms.

13. Governing Law

These Terms are governed by the laws of New South Wales, Australia. Any disputes will be resolved in the courts of New South Wales. If any provision of these Terms is found invalid, the remaining provisions remain in full effect.

14. Consumer Rights (Australian Consumer Law)

Your Rights Under Australian Consumer Law:

Our services come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the services supplied again if the services fail to be of acceptable quality and the failure does not amount to a major failure.
